Channel XR Warranty and Repair Policy

Effective Date: 05/23/2018

This Warranty and Repair Policy (“Policy”) applies to all products sold and distributed by Channel XR LLC, a value-added reseller serving customers in the United States and Canada. By purchasing products from Channel XR, you (“Customer”) agree to be bound by the terms and conditions set forth herein.


1. No Warranty by Channel XR

Channel XR LLC provides no warranty of any kind—express, implied, statutory, or otherwise—on any product sold through its website, sales team, or distribution channels. All warranties are provided solely and exclusively by the original equipment manufacturer (“OEM” or “Manufacturer”), if at all.

Channel XR does not warrant or guarantee:

  • The quality, condition, performance, or functionality of any product;

  • That any product is free of defects or will be fit for a particular purpose;

  • Continued availability of replacement parts or software updates.

ALL PRODUCTS ARE SOLD “AS IS” AND “AS AVAILABLE” FROM THE MANUFACTURER.


2. Manufacturer Warranties Only

Unless explicitly stated in writing by Channel XR, all warranty claims, product repairs, or service inquiries must be directed exclusively to the Manufacturer of the product. Customers are solely responsible for reviewing and complying with the Manufacturer’s warranty terms and procedures.

Channel XR does not:

  • Process, facilitate, or manage warranty claims;

  • Act as an intermediary between the Customer and the Manufacturer;

  • Store or track product warranty information, warranty cards, or receipts beyond standard invoice documentation.


3. Repair and Service Guidance

While Channel XR may, at its sole discretion and without obligation, assist a Customer in identifying the Manufacturer’s service contact information, Channel XR assumes no responsibility for the outcome, timeliness, or effectiveness of any warranty or repair process. Channel XR shall not be liable if a Manufacturer fails to honor its warranty or if repairs are delayed, denied, or performed unsatisfactorily.


4. Disclaimers and Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CHANNEL XR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY,

  • FITNESS FOR A PARTICULAR PURPOSE,

  • NON-INFRINGEMENT, AND

  • ANY WARRANTIES ARISING FROM COURSE OF DEALING, USAGE OF TRADE, OR PERFORMANCE.

IN NO EVENT SHALL CHANNEL XR BE LIABLE FOR:

  • ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES;

  • ANY LOSS OF PROFITS, DATA, BUSINESS, REVENUE, OR USE;

  • ANY DAMAGE TO PERSONS OR PROPERTY ARISING OUT OF OR RELATING TO THE SALE OR USE OF PRODUCTS.

CHANNEL XR’S TOTAL LIABILITY, IF ANY, SHALL BE STRICTLY LIMITED TO THE ACTUAL PURCHASE PRICE PAID BY THE CUSTOMER FOR THE PRODUCT GIVING RISE TO THE CLAIM.


5. Jurisdiction-Specific Notices

United States:
This Policy shall be governed by the laws of the State of [Insert State, e.g., Ohio], without regard to its conflicts of laws principles. Any disputes arising under this Policy shall be resolved exclusively in state or federal courts located within [Insert County/State].

Canada (including Quebec):
Where applicable under Canadian consumer protection laws, including but not limited to those in the Province of Quebec, certain limitations or disclaimers set forth in this Policy may not apply. In such cases, the Policy shall be deemed modified only to the minimum extent necessary to comply with applicable law.


6. Policy Subject to Change

Channel XR reserves the right to modify or update this Warranty and Repair Policy at any time, without prior notice. The most current version will always be posted on our website. Continued purchases or use of products after any such changes constitutes acceptance of the revised Policy.
